Terms and Conditions of the TQMsoft Website and the TQMsoft Training Mobile Application

§ 1. Definitions

1. Terms and Conditions – these Terms and Conditions governing the use of the TQMsoft Website.
2. TQMsoft – TQMsoft spółka z ograniczoną odpowiedzialnością, with its registered office at ul. Bociana 22a, 31-231 Kraków, Poland, registered with the District Court for Kraków-Śródmieście in Kraków, 11th Commercial Division of the National Court Register (KRS), under registration number 325010.
3. TQMsoft Website – the website available at tqmsoft.com, including the online store operated through it.
4. User – an individual conducting business activity, a legal entity, or an organizational unit without legal personality that uses the services provided by TQMsoft through the TQMsoft Website.
5. Services – services provided electronically by TQMsoft through the TQMsoft Website.
6. Products – goods offered for sale by TQMsoft to Users through the TQMsoft Website.

§ 2. General Provisions

1. TQMsoft sells Products and Services through the TQMsoft Website.
2. Before placing an Order through the TQMsoft Website, the Customer must read and accept these Terms and Conditions.
3. The TQMsoft Website offers Products and Services exclusively to companies and individuals conducting business activity.
4. The TQMsoft Website does not sell Products or Services to Users who qualify as consumers within the meaning of Article 221 of the Polish Civil Code of 23 April 1964 (Journal of Laws No. 16, item 93, as amended).
5. All Products offered through the TQMsoft Website are brand new, originally packaged, free from physical and legal defects, and legally placed on the Polish market.
6. To create an account and make purchases through the TQMsoft Website, the Customer must have an active email account.
7. Prices displayed on the TQMsoft Website are net prices expressed in Polish zloty (PLN). Sales of Products and Services are subject to VAT; therefore, the applicable VAT amount must be added to the net prices displayed on the website. VAT is automatically calculated and added before the Order is placed.
8. Prices do not include shipping costs.
9. Orders for Products and Services are processed in the order in which they are received.
10. To place an Order, the User must complete the order form available on the TQMsoft Website. The form requires the User to provide their purchasing details, including their Polish Tax Identification Number (NIP).
11. If the order form is completed incorrectly, TQMsoft reserves the right to suspend or cancel the Order.
12. Prices displayed on the TQMsoft Website become binding at the time the User places an Order.
13. TQMsoft reserves the right to change the prices of Products and Services, modify its product range, withdraw Products and Services, introduce new Products and Services, launch or cancel promotional campaigns on the TQMsoft Website, and modify the terms of such promotions.

§ 3. Payments and Order Fulfilment

1. Payments for Orders may be made by bank transfer or electronically through the DotPay payment system.
2. An Order is considered paid once the bank transfer has been credited to TQMsoft’s bank account or confirmation of payment has been received from DotPay.
3. After placing an Order, the User receives an order confirmation by email and is informed of the estimated processing time.
4. Products are delivered within Poland by a courier company selected by TQMsoft.
5. Shipping costs are borne by the User purchasing the Product.

§ 4. Complaints and Warranty Claims

1. Products are covered by the manufacturer’s warranty. The warranty period begins on the date the Product is delivered to the User.
2. Detailed warranty terms are provided with the Product and are also available on the manufacturer’s website.
3. The warranty covers manufacturing defects. It does not cover physical defects or mechanical damage caused by the User, or defects resulting from improper use.

§ 5. Privacy Policy and Personal Data Protection

1. TQMsoft is the data controller of personal data provided by Users of the TQMsoft Website.
2. Personal data is processed for the purpose of fulfilling sales agreements and may therefore be shared with entities responsible for delivering purchased Products.
3. Customers have the right to access their personal data and to request its correction, supplementation, updating, rectification, restriction of processing, or deletion.
4. The provision of personal data is voluntary.

§ 6. Final Provisions

1. Customers who have an account on the TQMsoft Website will be notified of any changes to these Terms and Conditions by email.
2. If a Customer does not accept changes to these Terms and Conditions, they will no longer be able to make purchases through the TQMsoft Website.
3. Any disputes between TQMsoft and the User shall be resolved by the competent common court having jurisdiction over TQMsoft’s registered office.
4. TQMsoft may amend these Terms and Conditions at any time, subject to the protection of acquired rights.
5. These Terms and Conditions have been in effect since 1 March 2016.
