Terms and Conditions of the TQMsoft Website

 

§ 1. Definitions

  1. Terms and Conditions - these Terms and Conditions of the TQMsoft Website.
  2. TQMsoft –the company TQMsoft spółka z ograniczoną odpowiedzialnością sp. k. with its registered seat at Bociana 22a street, 31-231 Kraków, registered in the District Court for Kraków-Śródmieście in Kraków, XI Commercial Department of the National Court Register under the KRS number 325010.
  3. TQMsoft Website - tqmsoft.com website, along with the online store located on it.
  4. User - a natural person running a business, a legal person, an organizational unit without legal personality, using the services provided by TQMsoft via the TQMsoft Website.
  5. Services - services provided by TQMsoft electronically via the TQMsoft Website.
  6. Products - items being the subject of sales made by TQMsoft to Users via the TQMsoft Website.

§ 2. General rules

  1. TQMsoft sells Products and Services via the TQMsoft Website.
  2. The condition for placing an Order on the TQMsoft Website by the Ordering Party is to read and accept the Terms and Conditions.
  3. The TQMsoft Website sells Products and Services only to companies and natural persons conducting business activity.
  4. The TQMsoft website does not provide the sales to Users who are consumers within the meaning of art. 221 of the Act of April 23, 1964. Civil Code (Journal of Laws, No. 16, item 93, as amended).
  5. All Products offered on the TQMsoft Website are brand new, originally packed, free from physical and legal defects, and have been legally introduced to the Polish market.
  6. In order to set up an account and make purchases on the TQMsoft Website, the Customer should have an active e-mail account.
  7. The prices given on the TQMsoft Website are net prices in Polish zlotys. The sales prices of Products and Services on the TQMsoft Website include VAT, therefore the amount of VAT should be added to the net prices provided on the website. It is automatically added before placing an order.
  8. Prices do not include shipping costs.
  9. Orders for Products and Services are processed according to the sequence of their reception.
  10. In order to place an order, please complete the form available on the TQMsoft Website. It is required to provide the data of the User making the purchase in the order form, including the Tax Identification Number.
  11. In the event of incorrect filling in the order form, TQMsoft has the right to suspend the implementation of the order or its cancellation.
  12. The prices given on the TQMsoft Website are binding from the moment of placing the order by the User.
  13. TQMsoft has the right to change the prices of Products and Services, change the assortment, remove Products and Services, introduce new Products and Services to the offer, carry out and cancel promotional campaigns on the TQMsoft Website, and make changes to them.

§ 3. Payments and fulfillment of orders

  1. Payments for orders can be made by bank transfer or via electronic payments made with the DotPay system.
  2. The order is treated as paid when the bank transfer is credited to TQMsoft's bank account or when receiving information from the DotPay service about the payment of the order.
  3. After placing the order, the User receives an order confirmation by e-mail and is informed about the estimated time.
  4. At territory of Poland, products are sent via a courier company selected by TQMsoft.
  5. The shipping cost is borne by the User purchasing the Product.

§ 4. Complaints

  1. The products are covered by the manufacturer's warranty. The warranty period is counted from the date of delivery of the Product to the User.
  2. Detailed warranty conditions are provided with the Product, as well as they are available on the manufacturer's website.
  3. The warranty covers manufacturing defects. The warranty does not cover physical defects and mechanical damage caused by the User, as well as defects caused by improper use.
  4. In the event of defects in the Products covered by the warranty, the User should send a warranty claim by e-mail to the following address info@tqmsoft.eu, including information about damaged elements and a description of the fault.

§ 5. Privacy policy and personal data protection

  1. The administrator of the databases of personal data provided by the TQMsoft Website Users is TQMsoft.
  2. Personal data is used to implement sales contracts, and therefore may be transferred to entities responsible for the delivery of purchased Products.
  3. Customers have the right to access their data and to correct, supplement, update, rectify, suspend their processing or delete them.
  4. The data is provided voluntarily.

 § 6. Final Provisions

  1. Customers who have an account on the TQMsoft Website will be informed about the change in the Terms and Conditions via e-mail.
  2. In the event of lacking acceptance for the changes to the Terms and Conditions, further purchases on the TQMsoft Website are impossible.
  3. Disputes between TQMsoft and the User will be resolved by the common court competent for the registered office of TQMsoft.
  4. The Terms and Conditions may be changed by TQMsoft at any time, subject to the protection of acquired rights.
  5. The Terms and Conditions are valid from March 1, 2016.
